States Challenge IR laws in High Court

High Court proceedings have commenced with every Australian state challenging the legality of the Howard Government’s radical new industrial relations workplace reforms.

Acting Employment Protection Minister John Kobelke said the new laws reduced the pay, employment conditions and job security of many Western Australian workers and their families.

The minister said the proceedings challenged the validity of John Howard’s Work Choices legislation that came into effect on March 27, this year.

All the state governments have objected to the legislation on the basis that it is unconstitutional and New South Wales led the combined states’ legal challenge.

Mr Kobelke said it would remain to be seen whether the Howard government has the right to overrule established constitutional practise by its reliance on the corporations power to underpin its Work Choices legislation.

The corporations power of the Constitution enables the Commonwealth to regulate foreign, trading or financial corporations but the Acting Minister disputed the corporations power gave the Commonwealth ‘a blank cheque’ over industrial relations.

John Kobelke said, ‘contrary to assertions from Canberra, the scope of the corporations power has yet to be judicially settled.’

“No other Federal Government has attempted to do what the Howard Government has done with the corporation’s power,’ the minister also said.

Mr Kobelke said he believes the High Court challenge will be one of the most significant constitutional cases in modern history and that the Carpenter government opposes the potential ill-effects of the legislation on workers and their families.

“The laws threaten the very essence of federalism and if the Howard Government has its way, the corporations power will be used to sideline the States.”

The High Court proceedings concluded yesterday, with a decision not expected until next year.

Ambidextrous children more likely to have problems at school, say researchers

Researchers say that ambidextrous children are at greater risk of difficulties at school, language problems, and disorders such as attention-deficit hyperactivity disorder (ADHD) than those who are left-handed or right-handed. Dr Alina Rodriguez, from the School of Public Health at Imperial College, London, and a team of researchers from various European universities studied nearly 8,000 children from the north of Finland; 87 of these were ambidextrous (mixed-handed). Parents, teachers and the children themselves assessed language skills, academic achievement and behaviour. At ages 7 and 8, the ambidextrous children had double the rate of language problems and were twice as likely to have problems at school. At age 15 and 16, the proportion of those with ADHD symptoms was twice as many in the ambidextrous group, and their ADHD symptoms tended to be worse. Ambidextrous children in the study also had a higher rate of language problems.

The number of people who are ambidextrous is unclear, with estimates ranging from 1% to 5%. Scientists do not know why some people use both hands when the majority of people prefer to use one predominantly. The theory is that there is something different in the brains of ambidextrous people, although Rodriguez says that more work in the area is needed.

A person who prefers using their right hand will have a more dominant left hemisphere of the brain, which is the part of the brain for language skills. Rodriguez and her researchers have suggested that the right hemisphere of the brain of an ambidextrous child is weaker compared to that of a right-handed child, increasing their susceptible to problems with attention. Previous suggestions about the causes of ADHD include the possibility that a person’s right hemisphere has weaker function. Earlier studies have drawn links between dyslexia and being ambidextrous, and other studies are looking at the part that differences between the two sides of the brain play in language skills and psychosis.

Rodriguez emphasised that the research, published in the journal Pediatrics in the United States, did not show that all ambidextrous children would have such problems, pointing out that most of the children in the survey did not develop them. “Our study suggests that handedness is really a marker for atypical foetal brain development — showing that the brain is working in a different way to the norm”, she said, adding that other studies have shown atypical brain development to be associated with extraordinary creativeness. She also suggested that the results may assist schools and health care workers in targeting children at risk of problems.

US president Obama, Congress call for blocking of executive bonuses at AIG insurance company

United States President Barack Obama stated Monday that insurance giant AIG is in financial trouble due to “recklessness and greed,” and called for legal action to stop the company from giving out millions of dollars in bonuses to its executives.

“It’s hard to understand how derivative traders at AIG warranted any bonuses, much less $165 million in extra pay,” Obama said. “How do they justify this outrage to the taxpayers who are keeping the company afloat.”

Obama’s statement comes after reports surfaced last weekend saying the insurance agency, which is in deep financial trouble, had paid US$165 million to executives in bonuses, after receiving $170 billion as part of a government bailout plan.

AIG has said that the bonuses have to be given out, as the company is legally required by contract to do so. A representative with the National Economic Council, Lawrence H. Summers, also said that the bonuses were required to be given out. If AIG had refused to give out the bonuses, employees could file a lawsuit against the company for the money.

“We cannot attract and retain the best and the brightest talent to lead and staff the A.I.G. businesses — which are now being operated principally on behalf of American taxpayers — if employees believe their compensation is subject to continued and arbitrary adjustment by the U.S. Treasury,” AIG CEO Edward M. Liddy said in a letter addressed to Treasury Secretary Timothy F. Geithner on Saturday.

Liddy said that he asked Geithner “to use that leverage and pursue every legal avenue to block these bonuses and make the American taxpayers whole.”

“I want everybody to be clear that Secretary Geithner’s been on the case,” Obama said. “He’s working to resolve this matter with the new CEO, Edward Liddy, who, by the way, everybody needs to understand, came on board after the contracts that led to these bonuses were agreed to last year.”

If the bonuses cannot be stopped, the U.S. Congress says they want AIG to reimburse the government. Congress is looking to impose stiff new taxes on the pay, or ordering the company to return the money which was originally granted from a government bailout. In a letter to House Speaker Nancy Pelosi on Tuesday, senator Richard Shelby promised that the treasury will recover all of the money. Several U.S. senators along with Liddy have sent letters to AIG asking for the bonuses to be renegotiated, something AIG agreed to and says they will reduce future bonuses by 30%. Senators state that if Libby does not respond by renegotiating the bonuses, the Senate Finance Committee will propose an excise tax. Not only will an excise tax be proposed on AIG, but all companies receiving bailout money and their employees who receive bonuses.

Numerous House Democrats have introduced legislation which would place a 100% tax on any bonuses of over $100,000 from companies that are receiving government bailout funds. Meanwhile in the Senate, a bipartisan proposal by Max Baucus (D-Montana) and Charles Grassley (R-Iowa) would levy a special 90% excise tax on AIG’s bonuses. Asked Senator Baucus, who chairs the Senate Finance Committee: “What is the highest excise tax we can impose that will stand up in court? Let’s find out.”

The opening ceremonies for the 2007 Baseball World Cup (2007 BWC) were held Tuesday. Torrential rain, however, made Panama vs Spain the opening match of the 2007 BWC in Taichung Intercontinental Baseball Stadium. The original opening match of Chinese Taipei vs Italy was postponed until next week and will be played at Tianmu Baseball Stadium.

“Recently, we got into a sticky situation while constructing a dome due to some protests by non-governmental people, but we’ll try to overcome these difficulties in order to present high-level sports to the international market.” Chin-chi Wu, the Director of the Taipei City Bureau of Education, remarked at Tuesday’s opening ceremony.

11+1 Questions To Ask Mortgage Brokers To Make Sure You Get A Good One Oct 18

Yesterday, someone asked me, What are some good questions to ask to choose the best mortgage. I thought it was a great question. Here are the questions I, a Chicago mortgage broker for eight years, would ask if I were looking for a mortgage.

1. What’s the interest rate?

This one’s obvious, lower is better. But to really get a good idea, you have to ask it together with the next one.

2. What’s the APR on this loan?

The lowest APR might not be the best, though. Some offers you get don’t include all the fees in the APR calculations. So, you have to also ask:

3. What are the fees included in the APR?

Get it in writing. Don’t ask if there are fees that are not included in the APR (Annual Percentage Rate, aka, the cost of the mortgage loan). If they don’t put all of them in the APR, they might lie here too. Compare APR fees line by line.

4. What are the closing costs, in dollars?

An APR based on all the fees would have them, but as mentioned above, not all APRs are complete. Besides, it’s easier to compare dollars vs. dollars. Again, get it in writing and signed. On a ‘Good Faith Estimate’ because those are the standard.

5. Do I have to pay discount and origination points? How many?

Technically, these should be questions 5 and 6 but they’re so closely related that I made them be #5 only. Sue me.

When you talk about discount points, a point equals 1% of the loan amount. You get a lower rate by paying discount points. Usually paying 1% upfront (1 discount point) lowers your interest rate by 0.125%.

On a $1,000, 30-year loan at 7.5% buying down the rate by 1 point ($1,000) lowers your monthly payments by $8.53. It takes 117 months (that’s 3 months short of 10 years) to get back your $1,000. Origination fees are fees your mortgage broker charges for doing the loan.

6. This one’s like the previous, a twofer. Does it cost me to lock the rate? When can I do it?

Interest rates change. If you like the one you’re being offered, you should lock. A lock is for a short period of time, usually long enough to get you the loan. If rates go up, you still get the low one you locked.

7. Does this loan have a prepayment penalty?

Some loans have them. Lenders give you a lower interest rate but want to make sure you stick around long enough for them to make the money they want. Whether they’re for 1% of the loan amount or 6 month’s worth of interest, you need to know. And you need to know how long you must wait to refinance the loan or get rid of it (as in when you pay if all off because you won the lotto or sold the home).

8. How much must the down payment be?

The interest and terms of your loan are in relation of the down payment. The higher the down payment, the less risk you represent, the lower the interest rate, the better the terms.

9. What’s required to qualify for this loan?

Different lenders have different rules. Some are stricter than others. You need to know all this upfront.

10. What are all the documents I will have to provide?

Depending on loan type and lender, the documentation required is different. Providing all the documents required speeds up things, ensures that your lock doesn’t expire.

11. How long is it going to take do get the mortgage loan?

The answers vary depending on what’s happening in the industry, in the country, on the lender itself. You need to have a good idea so you can know for how long to lock in your loan.

12. What can delay the approval process?

If you provide accurate and complete information from the start, there shouldn’t be problems. However, occasionally, there are things outside your control that can slow down the process. Such as, credit problems. (That’s why it’s best you get copies of your credit reports before you apply for a loan. To make sure the information there is accurate. The underwriter can still have problems. But having accurate credit reports reduces the possibilities of that happening.)

If things in your financial situation change, let your broker/lender know (you got a promotion, lost your job, got married, or divorced, etc.). To not do so could be fraud. Or deprive you of the benefits of getting a lower rate.

The answers to these questions should help you choose the right mortgage broker, the one that’s got the best mortgage for you. Whether they are Chicago mortgage brokers or not.

Walt Disney Co. reconciles with Disney heir

Today The Walt Disney Company issued a joint statement with business partners Roy E. Disney and Stanley Gold to the media, as a show of reunion between the two camps after nearly three years of hostility.

Roy E. Disney, son of company co-founder Roy O. Disney and nephew of the company namesake Walt Disney, had resigned from his job as chairman of Feature Animation at the company after experiencing difficulty with the company’s board of directors, many of whom were biased towards company CEO Michael Eisner‘s view of what direction the company should take.

Eisner is due to retire from the company this September, and the talks with Disney and Gold are believed to have been led by Eisner’s successor, Bob Iger, who is currently President and COO of the company. Iger has shown great interest in building relationships back up with many companies who have refused to work with Disney until Eisner leaves, such as Pixar Animation and George Lucas.

Large scores of Disney fans had hoped Roy would read the Disneyland Dedication Speech on the theme park’s fiftieth birthday next week, which was originally read by Walt on the park’s opening day, but Roy had already entered an annual sailing race from Los Angeles to Honolulu.

Opponents: New Zealand government sneaks bill into House to avoid public backlash

The New Zealand Government has tabled the Therapeutic Products and Medicines Bill, despite unprecedented political opposition.

In 2003 the Hon Annette King signed a Treaty with Australia agreeing to hand control of the natural health products sector over to an Australian regulatory body, however she needs to pass enabling legislation in New Zealand. “This will be a world-class joint scheme designed to regulate the safety, quality, effectiveness and promotion of therapeutic products in both New Zealand and Australia. That includes the regulation of complementary and alternative medicines, over-the-counter and prescription medicines, medical devices, blood and blood products and tissues and cellular therapies,” Ms King said.

Twice the Bill has been thrown out by select committees, but the Government is determined to ram it through Parliament, according to the New Zealand Health Trust.

“Late tonight the Bill was finally tabled, with no announcement from the Minister,” said Amy Adams, spokesperson for the Trust, “Clearly the Minister is keen to sneak it into Parliament under cover of the silly season, in the hope that she can keep it under the public’s radar.”

“I welcome the support of a majority of the House who want to see the Bill go to Select Committee where New Zealanders can have their say,” Ms King said.

The NZ Health Trust conducted research earlier this year which showed 62% of New Zealanders used natural health products. “This Bill represents a massive and irreparable change to the way we make rules for New Zealand dietary supplements,” Mrs Adams said.

“Under the proposed regime, well over a million New Zealand consumers would find the choice of products adversely affected, and experience cost increases. So you can see why the Government is trying to sneak this into the House without any fuss – they don’t want the public to know.”

All the political parties except Labour have pledged their opposition the proposal, despite some intense lobbying by Australian and New Zealand officials.

“It is a very serious thing to hand sovereignty over your country over to another nation,” Mrs Adams said. “And all the other political parties see the sense in making sure the sector is regulated from New Zealand – not as a minor state of Australia.”

Ms King said: “The Bill… ensures that New Zealand will have an equal say in the setting up and running of the new Authority and joint scheme.” The new authority will be like a crown-owned entity and will have to provide an anuual report and a statement of intent to parliament each year.
